Government Fee Litigation
Government agencies in California are required by the State Constitution to limit the amount of any fees or charges for government services or permits to the “reasonable cost of providing the service or permit.” BUT more often than not the charge that you the consumer or businessperson pay for that service or permit is grossly and unlawfully inflated far beyond the reasonable cost to the agency. Civil Litigation & Appeals
Litigation has been at the core of our practice for 25 years. While also counseling clients on the advantages of avoiding litigation, when litigation is warranted we aggressively represent our clients at all levels of the California State courts from Superior Court to the California Supreme Court, the federal district courts and Ninth Circuit, and the Court of Federal Claims. We also have extensive experience handling disputes involving neighbors, homeowners’ associations, and local agencies.
We counsel clients concerning the preparation, use and adequacy of Environmental Impact Statements under the National Environmental Policy Act and Environmental Impact Reports under the California Environmental Quality Act; we also represent clients in litigation challenging or defending the sufficiency of these statements or reports. We represent clients in negotiations and defend enforcement actions involving regulatory agencies such as the California Department of Fish & Game, the California Department of Toxic substances Control, and the Regional Water Quality Control Board concerning remediation projects.

Walter P. McNeill
Walt received his B.A. in Political Science and Public Policy Sciences from Duke University (’76) and his Juris Doctor from the University of the Pacific, McGeorge (’80). Before starting this firm, Walt worked for several boutique firms in Northern California practicing real estate, business and municipal law, as well as a stint of roughly seven years in the City Attorney’s Office for the City of Redding. Walt began a state-wide practice of Government Fee Litigation about 20 years ago, and today he is known as one of the preeminent attorneys in California in this growing specialty.
